Capstone Console
Terms of Service
Effective October 7, 2026
These terms govern your use of Capstone Console (the “Console”), operated by Capstone Hospitality LLC (“Capstone”, “we”, “us”). By signing in to the Console you agree to them.
1. Who may use the Console
The Console is a private business tool. You may use it only if Capstone has issued you an account — as a Capstone employee or contracted representative, or as staff of a club we represent whom we have invited — and only for work related to Capstone’s membership sales for those clubs.
Your account is personal to you. Keep your sign-in details confidential, do not share your account, and tell us straight away at kyle@capstone-hospitality.com if you think someone else has used it.
2. Acceptable use
When using the Console, you must not:
- access, or try to access, clubs, records or accounts you have not been given access to;
- try to bypass, probe or disable the Console’s security, or interfere with its operation;
- copy or export data other than through the Console’s own features, or use it for any purpose other than the work above;
- upload malicious code, or content that is unlawful or that you have no right to use; or
- use the Console to send spam, bulk unsolicited email, or anything misleading.
2A. SMS Terms (text messages)
Program. Capstone Hospitality membership texts. Capstone Hospitality LLC sends text messages on behalf of the private clubs it represents to people who asked about club membership and agreed to receive texts: replies to their questions, tour confirmations and reminders, and follow-ups about their inquiry.
Consent. Agreeing to texts is optional and is not a condition of purchase or membership.
Frequency and cost. Message frequency varies. Message and data rates may apply.
Opt out and help. Reply STOP to any text we send from our messaging number to cancel at any time; you will receive one confirmation and no further texts from that number. If a Capstone representative texts you from their own phone, reply STOP or tell them, and they will record your opt-out. Reply HELP for help, or email info@capstone-hospitality.com.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.
Privacy. How we handle your number and consent is in section 4B of our Privacy Policy.
3. Your connected mailbox and the email you send
Connecting a Google mailbox is optional. You can disconnect it under Settings → My Mailbox, or ask us at kyle@capstone-hospitality.com to disconnect it for you. By connecting a mailbox you confirm that you are authorized to connect it, including a club’s shared inquiry inbox. How the Console handles data from your mailbox is described in our Privacy Policy.
You are responsible for the email you send from the Console. Messages must be individual, relevant to the recipient’s interest in club membership, and must comply with the law that applies to them (including the CAN-SPAM Act), with the policies of the club you represent, and with Capstone’s instructions.
4. Records and data
Prospect and sales records in the Console belong to Capstone and the relevant club, as set out in our agreements with them. Your mailbox and its contents remain yours. We handle personal information as described in our Privacy Policy.
5. Changes and access
We may change, suspend or discontinue any part of the Console. We may suspend or end your access at any time — for example, when your work with Capstone or the club ends, or if you breach these terms.
6. No warranty
The Console is provided “as is” and “as available”. To the fullest extent the law allows, Capstone makes no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.
7. Limitation of liability
To the fullest extent the law allows, Capstone is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of, or inability to use, the Console.
8. Other agreements
If you have a separate written agreement with Capstone — for example an employment, contractor or club services agreement — that agreement governs wherever it conflicts with these terms.
9. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from them will be resolved in the state or federal courts located in Florida.
10. Changes to these terms
We may update these terms. We will post the new version on this page and update the effective date at the top; continuing to use the Console after that means you accept the updated terms.
